Acceptance of Terms

By creating an account or using Kept Showing Up (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

Description of Service

Kept Showing Up is software for personal trainers, coaches, and individuals to build programs, log workouts, track nutrition and progress, communicate, and manage coaching businesses. Features may change, and we may add, modify, or discontinue parts of the Service.

Accounts

You must provide accurate information, keep your login credentials secure, and are responsible for activity under your account. You must be at least 13 years old, and under 18 only with a parent or guardian's consent. We may suspend or terminate accounts that violate these terms.

Acceptable Use

Do not use the Service to break the law, infringe others' rights, upload harmful or unlawful content, harass anyone, attempt to access accounts or data that are not yours, scrape or reverse engineer the Service, or interfere with its operation or security.

Payments and Subscriptions

Paid plans are billed through Stripe on a recurring basis until cancelled. Prices and included features are shown at checkout. Subscriptions renew automatically for the same period unless cancelled before the renewal date. Except where required by law, payments are non-refundable, and cancelling stops future charges rather than refunding the current period. Taxes may apply. We may change pricing with notice for future billing periods.

Trainer and Client Relationship

Kept Showing Up is a software platform only. We are not a personal trainer, coach, gym, medical provider, or employer, and we are not a party to any agreement, waiver, or transaction between a trainer and a client. Trainers are solely responsible for the services they provide, their pricing, their contracts and waivers, and their compliance with applicable law. Clients contract directly with their trainer. Any documents signed through the Service are between those parties.

SMS / Text Messaging Terms

By providing a phone number and opting in, you agree to receive text messages from Kept Showing Up related to your account and the Service. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time and HELP for help. Carriers are not liable for delayed or undelivered messages. Consent to receive text messages is not a condition of any purchase. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. Content in the Service, including AI-generated programs, workouts, and nutrition targets, is for general fitness information only and is not medical advice, diagnosis, or treatment. Consult your physician before beginning any exercise or nutrition program. You participate at your own risk.

Assumption of Risk and Release

You choose to take part in physical exercise, training programs, and nutrition guidance through the Service voluntarily. Physical activity carries inherent risks, including muscle strains and sprains, fractures, cardiovascular events, and in rare cases serious injury or death. By using the Service, you acknowledge and accept those risks.

You confirm that you are in general good health and know of no medical condition that makes exercise unsafe for you, or that a licensed physician has cleared you to take part. You will stop immediately and seek medical help if you feel pain, dizziness, or unusual discomfort. Everything in the Service, including AI-generated programs, workouts, and nutrition targets, is general fitness guidance and is not medical advice, diagnosis, or treatment. Results vary and no specific outcome is promised.

To the fullest extent allowed by law, you release and hold harmless Kept Showing Up, its owners, employees, and affiliates from any claim, injury, loss, or damage arising out of your participation, except for harm caused by their own gross negligence or willful misconduct. Nothing here waives a right that cannot be waived under the law that applies to you. If the participant is under 18, a parent or legal guardian must agree on the participant's behalf.

Limitation of Liability

To the fullest extent permitted by law, Kept Showing Up and its owners, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or injury arising out of or related to your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.

Changes

We may update these terms from time to time. We will revise the effective date above and, for material changes, notify you in the app or by email. Continued use of the Service after an update means you accept the revised terms.
